COMMUNITY RULES AND REGULATIONS
KEEP YOUR PROPERTY MAINTAINED
Please be sure that you maintain your property. Mow the grass and trim the trees and hedges. Keep the walkway clear for our pedestrians. Please DO NOT allow hedges and trees to become overgrown and a hazard to those trying to walk. Please report any issues to the Town of Hempstead (489-5000), they will send a representative out to visit the home and issue a summons if necessary.
SNOW REMOVAL
Please note that all homeowners are responsible to clean the snow from their walks. This includes sidewalks on ALL property sides. If you live on a corner house you MUST clean the snow on both sidewalks.
GARBAGE
Town rules entitle us to have garbage collectors enter our off-curb property on the regular bi-weekly collection days. Please DO NOT take your cans to the curb. Please DO NOT leave your trash at the curb for days. It is a good idea to secure the tops of your garbage pails so as not to attract pests to climb in or topple over.
ANIMALS
DOGS: Dogs are a welcome part of the community, however, they must be walked with a leash at all times. They also MUST be cleaned up after. Dogs are NOT allowed on the beach at any time. You will be issued a summons. Please feel free to report any issue to the Animal Control Department (785-5220). If you are having a continual problem with a neighbor concerning the clean up of a dog, please try to work it out by discussing the situation calmly with them. If need be, please inform one of our members so we can try to intervene. We also have left notices for neighbors to remind them of the clean up issue.
STRAY CATS: We have had a problem with stray (feral) cats in our community. If you catch the animal, in a cage, the Town of Hempstead Animal Control Department will pick it up (785-5220). Please understand that if you feed the cats, they will come back.
RACCOONS/OPOSSUMS: Please do not attempt to corner a raccoon or opossum. Call the Animal Control Department. If these animals are out in the daytime, it usually means that they are ill. Please keep garbage secure and covered tightly at all times. This will discourage them from coming around to search for food.
BEACH RULES AND REGULATIONS
1. During the official season the hours of operation will be 10:00am to 6:00pm daily or as determined by the commissioner of Parks.
2. All residents are required to provide a copy of mortgage or rental agreement, utility bill (water, gas, electric) or NYS. Drivers license as proof of residency.
3. One vehicle pass and two beach tags will be issued per household. Residents must use vehicle pass and beach tags at all times (NO EXCEPTIONS). Cars with out pass will not be granted access to the parking lot.
4. All guests must enter with a resident member and cannot walk-in alone.
5. Lockers shall not be sublet and shall be occupied by resident of record & guests only.
6. For the personal comfort and welfare of all the residents, the lockers are not to be occupied at any time by more than a reasonable number of people, as determined by the Park Supervisor and the Town of Hempstead.
7. No barbeques or open flames of any kind are permitted.
8. No bands, DJ's or large audio equipment is permitted. All other audio equipment must be kept at an acceptable level.
9. The inside of the lockers may be checked periodically by the Town for safety and health purposes. The lockers are not to be painted or altered in any way.
10. The drawing on, or marking in any manor of the lockers, walls, structures, decking, or walkways is strictly prohibited.
11. The drying of clothing or towels on a rack, clothesline, or any structure is prohibited.
12. Walkways and stairways must be kept clear at all times.
13. No Frisbee or ball playing of any type will be allowed.
14. Only four chairs and one umbrella will be allowed per resident family in storage area.
15. No wagons, carts, bicycles, skateboards, roller blades, scooters, or other such type wheeled recreational equipment, with the exception of baby carriages, wheelchairs, or Town maintenance equipment will be allowed.
16. Glass containers or glass bottles of any kind are strictly prohibited in the club or on the beach.
17. The Town of Hempstead is not responsible for loss of property.
18. All types of kiddie pools, basins, tubes, etc. are strictly prohibited. Any violation constitutes a safety and health hazard.
19. Requests for any type of small gathering or party must be approved by the Park Supervisor and the Town of Hempstead Parks Dept.
20. All lockers must be cleaned out at the end of each season. No winter storing of items.
21. The dunes are a Federal & State environmentally protected area. There is no playing, digging, or trampling. Trespassers will be prosecuted.
22. Residents and quests shall abide by all rules & regulations set forth by the Town Board of the Town of Hempstead, pursuant to chapter 78 of the Town Code.
LOCKER LOTTERY
As most of you are probably aware, the Town of Hempstead Department of Parks & Recreation, in conjunction with the Atlantic Beach Estates Civic Association, had come to a mutual agreement that the lottery for the lockers at the beach club would be held every other year, on odd number years. Therefore, your locker assignment for this coming summer will be the same as last summer. Should you have any questions concerning locker assignments please do not hesitate to contact the Atlantic Beach Estates staff at (516) 239-8888 or (516) 432-2036.

In many cases, the illegally parked car was not from our neighborhood. Reporting to the Police can help prevent burglaries, and unwanted visitors from accessing the beach. If the car is actually a neighbor's car, they will still be ticketed, as that is the RULE of our community. Only through continued enforcement of this rule and YOUR help, can we get full compliance.

What you need to know about obtaining Building Permits and Variances:
For most renovations to your home you need to apply to the Town of Hempstead for a Building Permit. Call the Building Department at 516-489-5000 to obtain information to determine if you need a Building Permit and if so, how to apply and obtain an application for a Building Permit. Be sure it is filled out completely. After submitting the application for the Building Permit you’ll be informed if you need to file for a variance. Your architect, engineer or contractor, whomever you indicated to be the contact, will be notified if a variance is needed. You will get a copy of that letter from the town. If you are told that you need to, apply for a Variance. Owners of property within 200 feet of your property line must be notified of the variance request and the date and time of the hearing. All variance requests are published in Newsday every Friday in the Classified Section. You can also look online at the Town of Hempstead web page. www.townofhempstead.org. Click on Building and Zoning.
How do you react to a Variance request from your neighbor?
Talk to the neighbor.
Clearly voice your consent, support or your concerns.
Attempt to resolve your concerns.
If this is not successful, you should appear at the scheduled hearing. Register and indicate why you’re there. (For variance, against variance, just interested).
Be prepared to speak to the Zoning Board of Appeals.
Explain your concerns and problems with your neighbor’s building plan. Be specific.
If you’re at the hearing to support the Building Permit, state why.
You’ll be notified in writing of the decision of the Zoning Board of Appeals.
Once the permit has been approved, the TOH issues a poster that is positioned in a clear, visible area of the construction site. This poster is bright orange to stand out and has the details of what has been approved to be built.

If a resident believes that a business, landowner, proprietor or homeowner is not in compliance with the codes and ordinances of the Town of Hempstead, they can request a code enforcement officer to review the situation. Requests for code enforcement officers should be made in writing to:

If the incident warrants, code enforcement officers may issue court appearance tickets.
